Demand for removal from the post of National Independent Party President

Rabi Lamichhane was recently made Deputy Prime Minister and Home Minister in Nepal. Yuvraj Paudel, who filed a petition against him, had requested the court to remove Lamichhane from the post of President of the Rashtriya Swatantra Party. According to the Constitution of Nepal, only Nepali citizens have the right to vote, contest elections and form their own political party in the country. In fact, on this basis, the petitioner had raised questions through a petition regarding Lamichhane’s election to the House of Representatives, the lower house of the Nepal Parliament, and being on the post of the President of the RSP.

Did you give up Nepali citizenship?
In the petition filed against Rabi Lamichhane, information was also given about his renunciation of the citizenship of Nepal. In this, the petitioner had claimed that Yuvraj had acquired US citizenship. While filling the candidature form from Chitwan-2 constituency, he had given the documents of citizenship of Nepal for this.

On the other hand, Rabi Lamichhane is claiming that he has given up his US citizenship and has given the documents to the Immigration Department of Nepal. At the same time, he had also said that he has taken back the old citizenship of Nepal, but he had never mentioned earlier about taking back the old citizenship.

Nepal’s newspaper Kathmandu Post has written that a complaint was lodged against Lamichhane in the Election Commission regarding the issue of Nepalese citizenship. Then the Election Commission refused to act on it because Lamichhane was elected to the House of Representatives.

It is worth mentioning that in the Chitwan-2 election, TV journalist Lamichhane had to face a crushing defeat to the Communist Party of Nepal (UML) candidate. In June last year, he formed the RSP and won 20 seats in the RCP House of Representatives in the general elections held in Nepal in November 2022.
