Nirav Modi Case Fugitive Nirav Modi Seeks Permission To Appeal Extradition In Uk Top Court

PNB Scam Case: Fugitive diamond merchant Nirav Modi has filed an application in the London High Court seeking permission to appeal against the order of his extradition to India in the UK Supreme Court. The High Court of London had recently ordered Nirav Modi to be extradited to India to face charges of fraud and money laundering of around $2 billion in the Punjab National Bank (PNB) loan scam.
Nirav Modi is currently lodged in London’s Wandsworth Prison. He has two weeks to file an appeal on the basis of a point of law related to the interest of the general public. According to sources related to the UK Home Ministry, there are still many legal hurdles in the way of Nirav being extradited to India. The Crown Prosecution Service (CPS), acting on behalf of the Indian authorities, is now expected to respond to Nirav’s fresh application, after which the High Court judge will give a written decision.

Judge Jeremy Stuart-Smith and Judge Robert Jay had pronounced the decision to extradite Nirav to India on November 9. Based on the statement of psychiatric experts, the court had said that it does not feel that Nirav’s mental condition is unstable and the risk of his suicide is so high that extraditing him to India would prove to be an unjust and oppressive step. The judgment also said that “adequate security measures” have been taken in Barrack 12 of Arthur Road Jail in Mumbai, where the diamond merchant is to be kept after extradition.

Testimony of psychiatrists rejected
The CBI had said after the verdict that the testimony of two psychiatric experts during the final hearing of the Nirav Modi case in the London High Court proved to be crucial in rejecting the argument of his poor psychological condition and due to this the verdict went in favor of India. Nirav was given permission to appeal against the order in favor of extradition of District Judge Sam Gozzi of Westminster Magistrates Court in February this year. There are two cases against Nirav. One pertains to large scale forgery with PNB by fraudulently entering into loan agreement and obtaining consent letter, which is being probed by CBI
On the other hand, the second case is related to the laundering of black money obtained from this fraud, which is being investigated by the Enforcement Directorate (ED). There are also two additional charges of causing disappearance of evidence and intimidation of witnesses on Nirav.
